These Terms of Service apply to all orders placed through the online shop www.eldasio.com, as well as by email or phone. By placing an order, you agree to the terms set out below.
1. Scope
1.1 These Terms of Service apply to all orders placed by customers through the Eldasio online shop. Any deviating terms proposed by the customer are not recognized unless Eldasio has expressly agreed to them in writing.
1.2 These Terms apply to consumers, meaning natural persons who place an order for purposes that are outside their trade, business, craft, or profession.
2. Offer and Conclusion of Contract
2.1 The presentation of products in the Eldasio online shop does not constitute a legally binding offer, but rather an invitation for the customer to place an order.
2.2 By submitting an order through the checkout process, the customer makes a binding offer to purchase. Eldasio reserves the right to decline any order without stating reasons. An order confirmation sent by email does not yet constitute acceptance of the offer, it merely confirms that the order has been received. The contract is only concluded once Eldasio confirms acceptance of the order separately by email or ships the goods.
2.3 Eldasio reserves the right to adjust or limit individual features of the online shop at any time.
3. Prices and Payment
3.1 All prices shown in the online shop are final prices and include statutory value added tax as well as any other applicable price components. Delivery costs are shown separately during checkout.
3.2 Eldasio offers various payment methods. The payment options available to a customer are shown before the order is completed. Eldasio reserves the right to offer only certain payment methods for individual orders.
3.3 All prices are quoted in Euro.
4. Shipping and Delivery
4.1 Eldasio currently ships to addresses within Germany only. Orders are shipped from Germany or France depending on stock location.
4.2 Two shipping options are available at checkout:
Free Shipping: delivery within 4 to 5 business days at no additional cost.
Insured Express Shipping: delivery within 2 to 3 business days for a flat fee of 4.95 EUR. This option includes shipment insurance.
4.3 Delivery times are estimates and begin once the order has been confirmed and processed. Eldasio is not responsible for delays caused by the shipping carrier or events outside its reasonable control.
5. Retention of Title
The delivered goods remain the property of Eldasio until the purchase price has been paid in full.
6. Right of Withdrawal
Withdrawal Notice
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.

Email: info@eldasio.com of your decision to withdraw from this contract by a clear statement, for example a letter sent by post or an email. You may use the model withdrawal form below, though it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notice of your withdrawal. We will carry out such reimbursement using the same means of payment used for the original transaction unless expressly agreed otherwise, and no fees will be charged for the reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having returned the goods, whichever is earlier.
You must return the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract. The deadline is met if you send the goods before the 14 day period has expired.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

7. Warranty and Liability
7.1 Statutory warranty rights apply.
7.2 Claims for damages by the customer are excluded unless stated otherwise below. This does not apply to damages resulting from injury to life, body, or health, nor to damages arising from a breach of essential contractual obligations, nor to damages caused by intentional or grossly negligent conduct by Eldasio, its legal representatives, or vicarious agents.
7.3 Where essential contractual obligations are breached, Eldasio is only liable for foreseeable damage typical for this type of contract if such breach was caused by ordinary negligence, unless the damage relates to injury to life, body, or health.
7.4 The above limitations of liability also apply in favor of the legal representatives and vicarious agents of Eldasio, where claims are asserted directly against them.
8. Data Protection
The collection, processing, and use of personal data takes place in accordance with applicable data protection law. Further information can be found in our Privacy Policy, available on our website at any time.
9. Assignment and Transfer
Eldasio is entitled to transfer rights and obligations arising from the contractual relationship, in whole or in part, to third parties. In the event of such a transfer, the customer is entitled to terminate the contract at the time of transfer.
Eldasio is entitled to assign outstanding claims to third parties for collection purposes.
10. Promotions and Discounts
From time to time, Eldasio may run promotions that reduce the price of certain products. Where a promotion is activated by a discount code, the customer must enter the code at checkout. Each promotion, discount, and offer is subject to its own conditions, communicated at the time it is introduced. Unique, personal discount codes are non transferable and may not be shared publicly.
Promotions, discount codes, and offers cannot be combined with one another.
Offers have no cash value and cannot be applied to previous purchases or the purchase of gift cards. Eldasio reserves the right to modify or end promotions at any time without prior notice.
11. Final Provisions
11.1 Contracts between Eldasio and its customers are governed by German law. Where the customer is a consumer, this choice of law only applies to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
11.2 Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.
11.3 The European Commission provides a platform for online dispute resolution, available at ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
